1. Agreement and who we are

By using sweetspotclub.com or placing an order, you agree to these Terms of Service, our Return & Refund Policy and our Privacy Policy. If you don't agree, please don't use the site.

Sweet Spot Club is operated by AUM 108 Inc, 510 Jericho Tpke, Syosset, NY 11791, United States ("we," "us"). The store runs on Shopify.

How we work. We curate golf, pickleball and gift products from independent partner brands. When you buy, you buy from Sweet Spot Club: we take your payment, and we're your point of contact for the order. The partner brand that makes each product packs and ships it to you directly from its own warehouse, and receives returns of its own products.

You must be at least 18, or the age of majority where you live, to place an order.

2. Accounts, orders, pricing and payment

Your account. You need a customer account to track orders and request returns. Keep your sign-in details secure; you're responsible for activity on your account. Give us accurate contact and shipping information.

Orders. Your order is an offer to buy. It's accepted when the brand confirms it can fulfill the item, not when you receive an order confirmation email. We may cancel or limit any order, for example if an item is out of stock at the brand, a price is listed in error, or we suspect fraud or resale. If we cancel after charging you, we refund you in full.

Availability. Stock levels come from our partner brands and can change between when you order and when the brand processes it. If part of your order can't be filled, we cancel and refund that part and ship the rest.

Pricing. Prices are in US dollars and exclude shipping and applicable sales tax, which are shown at checkout. A crossed-out "compare at" price is a reference price supplied by the brand. We correct pricing errors when we find them, even after an order is placed, and give you the choice to proceed at the correct price or cancel.

Payment. We accept the payment methods shown at checkout, processed by Shopify and its payment partners. You authorize us to charge your chosen method for the full order total. Discount codes can't be combined unless stated, have no cash value, and can be withdrawn at any time.

3. Shipping and delivery

Each item ships directly from the brand that makes it. An order with products from several brands arrives in separate packages, on different days, with separate tracking. Shipping charges are calculated per brand and shown at checkout.

We ship to addresses within the United States only. Delivery estimates come from the brands and carriers and aren't guaranteed. Title and risk of loss pass to you when the carrier delivers the package to your shipping address.

If tracking shows delivered but you can't find your package, contact us within 7 days of the delivery date and we'll open a trace with the carrier and the brand. We aren't responsible for packages lost after delivery to the address you gave us.

4. Returns, product information and warranties

Returns and refunds. Returns are governed by our Return & Refund Policy, which forms part of these terms. In short:

Each item's return window is set by the brand that shipped it and shown in your account.
Returns are requested only through your customer account. Eligible requests are approved automatically.
Items go back to the brand that shipped them. Where a brand provides return labels, you receive a prepaid label; otherwise you ship the item to the brand's address at your own cost.
Final Sale, personalized, made-to-order and used items can't be returned unless they arrive damaged, defective or wrong.
Refunds go to your original payment method after the brand receives and inspects the item.

Product information. Descriptions, specifications, sizing and images are provided by our partner brands. We work to keep them accurate, but colors vary by screen and brands may update products without notice. If an item isn't as described, return it under the policy above.

Warranties. Any manufacturer warranty comes from the brand that makes the product, under that brand's terms. We'll pass warranty claims to the brand for you. Apart from that, products are sold "as is" to the extent the law allows.

Chargebacks. Please contact us before disputing a charge with your bank. Filing a dispute for an order you received and didn't return may lead us to close your account.

5. Using the site, intellectual property and reviews

Acceptable use. Don't use the site to break the law, buy for unauthorized resale, scrape or copy product data, interfere with the site's security or operation, or impersonate anyone. We may suspend or close accounts that do.

Intellectual property. The site's design, text and graphics belong to us or our licensors. Product names, logos and images belong to the partner brands and other owners and are used to identify their products. Nothing here gives you a license to use them.

Reviews and submissions. If you post a review, photo or other content, you confirm it's yours and honest, and you give us a free, worldwide, non-exclusive license to display and use it in connection with the store. We may remove content at our discretion.

Third-party links and services. Links to other sites, and services such as payment processing and carriers, are run by third parties under their own terms. We aren't responsible for them.

6. Legal terms and contact

Disclaimer. The site and its content are provided "as is" and "as available." To the extent the law allows, we disclaim implied warranties, including merchantability and fitness for a particular purpose, apart from any warranty a brand provides with its product.

Limitation of liability. To the extent the law allows, we aren't liable for indirect, incidental or consequential damages. Our total liability for any claim about an order is limited to the amount you paid for that order. Sports equipment involves physical activity; use it as the brand directs.

Indemnity. You agree to cover our reasonable losses from claims caused by your breach of these terms or misuse of the site.

Governing law and disputes. These terms are governed by the laws of the State of New York. Disputes go to the state or federal courts in Nassau County, New York, except that either of us may bring an eligible claim in small-claims court where you live.

Nothing limits your rights. Some places don't allow certain exclusions above. Where that's the case, they apply only as far as the law permits, and your statutory consumer rights are unaffected.

Changes. We may update these terms. The version posted when you place an order applies to that order. If any part is found unenforceable, the rest still applies.
